Trading Terms for Canadian members

1. Seller

Purchase of Premium membership and other services on Sugarfar.com is made from:

Disp is a Danish-registered partnership selling digital subscription services to Canadian consumers on a cross-border basis. Although Danish law primarily governs the contract, your non-waivable rights as a Canadian consumer under federal and provincial consumer protection legislation are preserved.

2. Payment

All payments are processed securely by a PCI DSS certified payment provider. Sugarfar never has access to your card details — they are handled exclusively by the payment provider and are never stored on our servers.

On your bank or credit card statement, the payment will appear as "Disp" — the company behind Sugarfar.

We accept the following payment methods commonly used in Canada:

  • Visa, Mastercard and American Express (credit and debit cards, including Visa Debit and Debit Mastercard)
  • Apple Pay and Google Pay (where supported)

Interac e-Transfer is not currently supported because it is not a recurring-payment instrument.

3. Subscription and automatic renewal

When purchasing a Premium membership, you enter into a recurring subscription agreement. In compliance with provincial consumer protection rules on automatic renewals (including Quebec's Consumer Protection Act and similar provisions in Ontario, BC and Alberta):

  • Your subscription is automatically renewed upon expiry of the selected period
  • Renewal takes place 2 hours before expiry — therefore cancel in good time if you do not wish to renew
  • The renewal price, frequency and minimum term are clearly disclosed before purchase
  • You can view your subscription status, renewal date and price at any time under My Account → Membership

4. Cancellation

You can cancel your subscription at any time:

  • Go to My Account → Membership and click "Cancel subscription"
  • The cancellation takes effect at the end of your current billing period — you retain access to Premium until then
  • No further payments will be charged after cancellation
  • Cancellation must be made at least 2 hours before your next renewal date to avoid automatic renewal
  • You may cancel using the in-app button — no phone call is required, consistent with the simplified-cancellation expectations under provincial consumer law

5. Right of withdrawal / cooling-off

Canadian federal law does not impose a uniform cooling-off period for online digital subscriptions, but Quebec consumers benefit from rights under the Consumer Protection Act, and several provinces provide remedies for distance/internet contracts. As a goodwill matter, we offer a 14-day right of withdrawal modeled on Danish/EU consumer law:

You have a 14-day right of withdrawal from the date of purchase. By completing the purchase, you agree that your Premium access is delivered immediately. If you withdraw after you have started using the access, we refund the amount paid less a proportionate share for the period you had access up until you notified us of the withdrawal.

To exercise this right, send us an unequivocal notice at support@sugarfar.com within 14 days of the purchase — please include your username and the purchase date. We will issue the refund to the original payment method no later than 14 days after receiving your notice.

You can also always cancel your subscription so that it does not renew (see section 4).

6. Prices and taxes

Prices for Canadian customers are displayed in Canadian dollars (CAD, $). The current prices are always shown on the page before you complete a purchase.

Canadian GST/HST applies to digital subscriptions sold to Canadian consumers under the federal simplified-GST/HST regime for non-resident digital service providers. The applicable rate depends on your province of residence:

  • 5% GST (AB, BC, MB, NT, NU, QC, SK, YT — note: QC also charges 9.975% QST separately)
  • 13% HST (ON)
  • 14% HST (NS — under transition rules)
  • 15% HST (NB, NL, PE, NS)

Tax is calculated by our payment provider at checkout based on your billing address and shown before payment. Quebec residents may also be charged Quebec Sales Tax (QST) where applicable.

We reserve the right to change prices. Price changes will not affect existing, active subscriptions and apply only upon the next renewal after cancellation and re-subscription.

7. Card renewal and failed payments

If your payment cannot be processed (e.g., due to an expired card or insufficient funds), this is treated as a cancellation:

  • Your Premium membership remains active for the remainder of the paid period
  • After that, your account will be downgraded to the free tier
  • You can subscribe again at any time with a different payment card

If you wish to change your payment card, you must first cancel your existing subscription or let it expire, and then create a new subscription with the new card.

8. Receipt

A receipt for your purchase, with CAD pricing and any applicable GST/HST/QST, can be found under My Account → Membership. You will also receive a receipt from our payment provider at the email address associated with your account. Receipts include our GST/HST registration number where required.

9. Data security

All information on Sugarfar is treated confidentially and in accordance with our privacy policy. All communication between your browser and our servers takes place via HTTPS encryption. Payment details are handled exclusively by our payment provider and are never stored on our servers.

10. Liability and limitations

Sugarfar is a communication platform that facilitates contact between users. Subject to your non-waivable consumer rights under federal and provincial Canadian law, we are not responsible for:

  • The content of messages and interactions between users
  • Loss arising from downtime, maintenance or force majeure
  • Actions taken by other users on the platform

To the maximum extent permitted by applicable Canadian law, our aggregate liability is limited to the amounts you have paid us in the twelve months preceding the claim. Nothing in these terms limits liability that cannot be limited under provincial consumer protection law.

11. Governing law and dispute resolution

These terms of sale are governed by Danish law without regard to conflict-of-laws principles, except that mandatory provisions of consumer law in your province or territory of residence (in particular Quebec's Consumer Protection Act) continue to apply. Disputes shall first be resolved by direct negotiation in good faith.

If a dispute cannot be resolved amicably, Canadian consumers may file a complaint with the Competition Bureau Canada at competitionbureau.gc.ca, or your provincial consumer protection office (e.g., Office de la protection du consommateur in Quebec, Consumer Protection Ontario in Ontario, Consumer Protection BC in British Columbia).

Payment issues and chargebacks

If you experience a problem with a payment (for example a duplicate charge), please contact us at support@sugarfar.com before contacting your bank — we resolve issues quickly, and documented errors are always refunded. If a payment dispute (chargeback) is filed against a charge that was made correctly under these terms, we reserve the right to suspend or close the associated account while the matter is resolved. This does not affect your right of withdrawal or any other rights you have under applicable consumer law.
