Trading Terms for New Zealand members

1. Seller

Disp is a Danish-registered partnership selling digital subscription services to New Zealand consumers on a cross-border basis. Although Danish law primarily governs the contract, the consumer guarantees under the Consumer Guarantees Act 1993 and the prohibitions on misleading and deceptive conduct under the Fair Trading Act 1986 apply where the supply is made to a consumer in New Zealand.
2. Payment
All payments are processed securely by a PCI DSS certified payment provider. Sugarfar never has access to your card details — they are handled exclusively by the payment provider and are never stored on our servers.
On your bank or credit card statement, the payment will appear as "Disp" — the company behind Sugarfar.
We accept the following payment methods commonly used in New Zealand:
- Visa, Mastercard and American Express (credit and debit cards)
- Apple Pay and Google Pay (where supported)
POLi and direct debit are not currently supported because they are not designed for international recurring online subscription billing.
3. Subscription and automatic renewal
When purchasing a Premium membership, you enter into a recurring subscription agreement. Consistent with the Fair Trading Act 1986 and Commerce Commission guidance on unsubstantiated representations and unfair contract terms:
- Your subscription is automatically renewed upon expiry of the selected period
- Renewal takes place 2 hours before expiry — therefore cancel in good time if you do not wish to renew
- The renewal price, frequency and minimum term are clearly disclosed before purchase
- You can view your subscription status, renewal date and price at any time under My Account → Membership
4. Cancellation
You can cancel your subscription at any time:
- Go to My Account → Membership and click "Cancel subscription"
- The cancellation takes effect at the end of your current billing period — you retain access to Premium until then
- No further payments will be charged after cancellation
- Cancellation must be made at least 2 hours before your next renewal date to avoid automatic renewal
- You may cancel using the in-app button — no phone call is required
5. Right of withdrawal / refunds
New Zealand law does not impose a general statutory "cooling-off" right for online digital subscriptions, but the Consumer Guarantees Act 1993 requires services to be supplied with reasonable care and skill, fit for any disclosed purpose, and within a reasonable time. As a goodwill matter we offer a 14-day right of withdrawal modeled on Danish/EU consumer law:
You have a 14-day right of withdrawal from the date of purchase. By completing the purchase, you agree that your Premium access is delivered immediately. If you withdraw after you have started using the access, we refund the amount paid less a proportionate share for the period you had access up until you notified us of the withdrawal.
To exercise this right, send us an unequivocal notice at support@sugarfar.com within 14 days of the purchase — please include your username and the purchase date. We will issue the refund to the original payment method no later than 14 days after receiving your notice.
You can also always cancel your subscription so that it does not renew (see section 4). For failures to comply with a Consumer Guarantees Act guarantee, you are entitled to a remedy regardless of the 14-day window.
6. Prices and GST
Prices for New Zealand customers are displayed in New Zealand dollars (NZD, NZ$). The current prices are always shown on the page before you complete a purchase.
Prices are GST-inclusive where applicable. New Zealand's Goods and Services Tax (GST) is a flat 15% and applies to remote services supplied to New Zealand consumers under the Goods and Services Tax Act 1985 (the rules for non-resident suppliers introduced in 2016). GST is calculated by our payment provider at checkout and is included in the displayed price.
We reserve the right to change prices. Price changes will not affect existing, active subscriptions and apply only upon the next renewal after cancellation and re-subscription.
7. Card renewal and failed payments
If your payment cannot be processed (e.g., due to an expired card or insufficient funds), this is treated as a cancellation:
- Your Premium membership remains active for the remainder of the paid period
- After that, your account will be downgraded to the free tier
- You can subscribe again at any time with a different payment card
If you wish to change your payment card, you must first cancel your existing subscription or let it expire, and then create a new subscription with the new card.
8. Tax invoice
A tax invoice for your purchase, in NZD with 15% GST shown separately where applicable, can be found under My Account → Membership. You will also receive a receipt from our payment provider at the email address associated with your account.
9. Data security
All information on Sugarfar is treated confidentially and in accordance with our privacy policy. All communication between your browser and our servers takes place via HTTPS encryption. Payment details are handled exclusively by our payment provider and are never stored on our servers.
10. Liability and limitations
Sugarfar is a communication platform that facilitates contact between users. Subject to the consumer guarantees in the Consumer Guarantees Act 1993 (which cannot be excluded for consumer supplies), we are not responsible for:
- The content of messages and interactions between users
- Loss arising from downtime, maintenance or force majeure
- Actions taken by other users on the platform
Where the Consumer Guarantees Act applies and our service fails to comply with a guarantee, you are entitled to a remedy under that Act. To the maximum extent permitted by law, our other liability is limited to (at our option) re-supplying the service or refunding the price paid.
11. Governing law and dispute resolution
These terms of sale are governed by Danish law without regard to conflict-of-laws principles, except that mandatory provisions of the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 continue to apply where the supply is made to a consumer in New Zealand. Disputes shall first be resolved by direct negotiation in good faith.
If a dispute cannot be resolved amicably, New Zealand consumers may lodge a complaint with the Commerce Commission at comcom.govt.nz, contact Consumer Protection (Ministry of Business, Innovation and Employment) at consumerprotection.govt.nz, or take the matter to the Disputes Tribunal for claims under NZ$30,000.

Payment issues and chargebacks
If you experience a problem with a payment (for example a duplicate charge), please contact us at support@sugarfar.com before contacting your bank — we resolve issues quickly, and documented errors are always refunded. If a payment dispute (chargeback) is filed against a charge that was made correctly under these terms, we reserve the right to suspend or close the associated account while the matter is resolved. This does not affect your right of withdrawal or any other rights you have under applicable consumer law.
