Sugarfar Terms of Service for New Zealand Members

At Sugarfar, we strive to create a safe environment for our New Zealand members, and our users should have no doubt that they are in good hands with us. Our focus is to ensure that all users have a safe and respectful experience, in line with the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. We encourage all our users to report any offensive, harassing, or inappropriate content intended to demean other users or that otherwise violates these terms. All reports are reviewed by our support team.

Terms for profiles

  • To create a profile on Sugarfar, you must be at least 18 years old.
  • When you create a profile and share content on Sugarfar, you grant us a non-exclusive, royalty-free, worldwide licence to display your profile to other users on Sugarfar, including via email and on the site.
  • You may not offer the recipient any form of services in exchange for money, including sex. Disclaimer: Sugarfar is NOT an escort service. Although adult sex work between consenting adults is decriminalised in New Zealand under the Prostitution Reform Act 2003, our platform is not licensed for and does not facilitate commercial sexual services. Conduct that breaches the Prostitution Reform Act 2003, the Crimes Act 1961, or anti-trafficking provisions will result in immediate action.
  • You may not use Sugarfar if you have been convicted of a sexual offence or are subject to a current order under the Child Protection (Child Sex Offender Government Agency Registration) Act 2016.
  • You may not share your own or others' email address, Snapchat, Facebook, Skype, phone number or any other form of contact information in your profile text.
  • You may not link to other websites from your profile or otherwise direct visitors to your own or others' websites.
  • It is illegal under the Crimes Act 1961 to enter a false or another person's email address, phone number or other personal information for the purposes of impersonation, fraud or identity-related offences.
  • By providing your email address, you consent to receive commercial electronic messages from us. Each newsletter contains a functional unsubscribe facility, as required by the Unsolicited Electronic Messages Act 2007. We will action unsubscribe requests within 5 working days.
  • As a registered user you have rights under the Privacy Act 2020. You may request access to and correction of your personal information at any time. If you no longer wish us to process your personal information, please refrain from using Sugarfar.
  • By uploading images, you acknowledge that Sugarfar has the right to modify the material and to reject or delete the material at its discretion.
  • Profiles whose primary purpose is the sale of videos, photos, webcam shows, phone calls or similar, and which are of the nature of actual prostitution, will be deleted/blocked without notice.

Terms for profile photos

  • The photo must be of yourself.
  • The photo must not contain logos, links or references to other websites.
  • The photo must not contain contact information.
  • The photo must not contain offensive, hateful, violent, threatening or illegal activity. This includes content that would be classified "objectionable" under the Films, Videos, and Publications Classification Act 1993, or that contravenes the Harmful Digital Communications Act 2015.
  • The photo must not be strongly erotic or pornographic — breasts and genitals must be covered.
  • The photo must be recent, and you must own the copyright in accordance with the Copyright Act 1994.
  • The photo must not contain wasted space and must be correctly oriented.

Terms for profile content

Including profile texts, sending messages and profile names:

  • Profile text must not contain contact information (including social networks, phone numbers or any other forms of communication tools).
  • You may not offer money for sexual services. Activities suspected of involving human trafficking, slavery or coerced sex work (sections 98 and 98AA of the Crimes Act 1961) will result in immediate closure of the profile without warning and may be reported to New Zealand Police. The Police can be contacted on 105 (non-emergency) or 111 (emergency). This includes all profile content (profile text, profile name and photos).
  • You may not write content that constitutes a harmful digital communication under the Harmful Digital Communications Act 2015 (e.g., content that is grossly offensive, threatening, intimidating, or that incites suicide or self-harm), nor content that breaches the Human Rights Act 1993.
  • Profile names must not contain contact information, including email addresses, references to social media or website addresses.
  • The profile name must be decent and must not be of a grossly vulgar or offensive nature.
  • Profile text must not contain derogatory or racist remarks about other people or groups.
  • Sugarfar may at any time, without notice, delete posts or profiles if one or more of the above conditions are not met. We have the right to review a profile's content and personal messages if the profile is reported or if there is a reasonable suspicion that the profile violates the guidelines or applicable New Zealand law. All content will remain confidential except where disclosure is required by valid legal process (such as a production order under the Search and Surveillance Act 2012).

Important warnings

We advise all users against giving money, bank transfers or gift cards to people they do not know personally. Such requests are most often "romance scams" intended to defraud users. CERT NZ and Netsafe regularly warn that romance scams are among the highest-loss scams in New Zealand.

We advise all users against sharing sensitive personal information, including IRD numbers, driver's licence or passport numbers, bank account numbers, or home addresses.

Sugarfar is established as a communication platform between users. We are an intermediary and not the publisher of content sent between users. If you have had a negative experience, you are welcome to contact us. We will investigate and, if appropriate, exercise the powers available to us under these terms. If the experience involved a harmful digital communication, you may also contact Netsafe (the approved agency under the Harmful Digital Communications Act 2015) at netsafe.org.nz.

We encourage everyone to report profiles via the report button for any violations of the above terms. In cases of doubt regarding the interpretation of these terms, Sugarfar makes the final decision.

These terms are governed by Danish law (because Disp I/S is registered in Denmark), without prejudice to the consumer guarantees and other non-excludable rights you have as a consumer under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Nothing in these terms excludes, restricts or modifies any consumer guarantee that cannot be excluded under those Acts. In the event of a violation of New Zealand criminal law, we may report the matter to law enforcement, including IP addresses used for login/registration and any other relevant information.
